Welcome to Nightly Stories. These Terms of Service are the agreement between you and Nightly Stories that governs your use of our mobile app and website. Please read them — by creating an account or using the app, you agree to them.
These Terms of Service ("Terms") form a legally binding agreement between you and Nightly Stories ("we," "us," "our") governing your use of the Nightly Stories mobile application and the website at nightlystories.app (together, the "Service").
By downloading, installing, creating an account, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
You must be at least 18 years of age and legally capable of entering into a binding contract to create a Nightly Stories account. The Service is intended to be operated by a parent or legal guardian on behalf of a child.
Children may enjoy the stories under a parent's supervision, but child accounts are not permitted and children may not create accounts, log sleep data on their own, or make in-app purchases.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
You may delete your account at any time from within the App (Profile → Delete Account) or by writing to us.
Certain features of Nightly Stories require a paid subscription ("Pro" or "Pro+"). Subscription plans, prices, and billing cycles are shown in the App before purchase and may vary by region.
All subscriptions are purchased and billed through the Apple App Store (iOS) or Google Play (Android). By subscribing, you authorize the applicable store to charge the payment method on file at the price shown, at the start of each billing period, until you cancel.
Auto-renewal: Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before renewal. We do not directly control the charge — Apple and Google do. Your subscription price at renewal may differ if we've published a price change; the store will notify you before the new price takes effect.
If we offer a free trial, the terms of that trial (length, eligibility, converting plan) are shown in the App at signup. Unless you cancel before the trial ends, you will be charged for the first paid billing period automatically.
You can cancel your subscription anytime from your device's subscription settings:
Cancellation stops future renewals. Your subscription remains active until the end of the current billing period; no partial refund is issued for the unused portion.
Refund requests are handled by Apple or Google under their respective refund policies. We generally cannot process refunds directly, but we're happy to help — please contact us at nightlystoriesapp@gmail.com if you need help.
The Nightly Stories app, its design, source code, brand marks, illustrations, templates, editorial rules, and story-generation pipeline are the intellectual property of Nightly Stories and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works based on the Service except as expressly permitted.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own for your family's personal, non-commercial bedtime use.
Stories are generated using AI systems informed by the child profile you configure and our editorial rules. Because AI output is probabilistic, we cannot guarantee any specific story's phrasing, plot, or accuracy. We work continuously to keep every story bedtime-safe, calm, and age-appropriate, and we run each story through automated safety and moderation checks before showing it to you.
Ownership of AI-generated content: Stories generated for your child through your account are for your family's personal, non-commercial use. You may read, listen to, save, and share them privately with immediate family. You may not resell, republish, or use them for commercial purposes.
Reporting a story: If a story ever feels off — too intense, inappropriate, factually misleading, or otherwise not bedtime-appropriate — please tell us at nightlystoriesapp@gmail.com. Every report improves the system.

Nightly Stories is a family-facing app designed to be used with adult supervision. As a parent or guardian, you are responsible for:
The Service integrates with third-party platforms (e.g., Apple App Store, Google Play, cloud infrastructure providers, notification services). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for their availability, content, or practices.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Nightly Stories is not a medical, therapeutic, or diagnostic tool. Sleep insights are informational only and are not medical advice. If your child has sleep concerns, please consult a qualified healthcare professional.
To the maximum extent permitted by law, Nightly Stories and its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising out of or related to your use of the Service.
Our total aggregate liability to you for all claims arising out of or related to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months immediately before the event giving rise to the liability, or (b) US$50.
You agree to indemnify and hold harmless Nightly Stories and its team from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
You may terminate your use of the Service at any time by deleting your account from within the App (Profile → Delete Account) or by writing to us at nightlystoriesapp@gmail.com.
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if we are required to do so by law.
Upon termination, your right to use the Service ceases immediately. Your account, child profiles, sleep logs, and generated stories are permanently removed from our production databases per the timelines described in our Privacy Policy. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email before the changes take effect, and update the "Last updated" date at the top of this page. Continued use of the Service after the effective date means you accept the updated Terms.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Nightly Stories is established, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the competent courts of that jurisdiction, subject to any mandatory consumer protection laws that apply to you where you live.
If you are a consumer resident in the European Union, you may also be entitled to resolve disputes through the European Commission's Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr.
